1. ACCEPTANCE OF TERMS

Welcome to Checkfit. By accessing or using our service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our service.

2. DESCRIPTION OF SERVICE

Checkfit provides a virtual try-on platform that uses artificial intelligence to create personalized models based on user-uploaded images, allowing users to visualize how clothing items might look on them.

3. ACCOUNT REGISTRATION

3.1 You must be at least 18 years old to use Checkfit.

3.2 You must provide accurate, current, and complete information during registration.

3.3 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.4 We reserve the right to refuse service, terminate accounts, or remove content at our discretion.

4. USER CONTENT

4.1 By uploading images to our platform, you grant Checkfit a limited, non-exclusive, worldwide license to use, process, store, and transfer such images solely for the purpose of:

• Creating your personalized AI model
• Providing the virtual try-on service
• Improving our algorithms and services

4.2 You represent and warrant that:

• You own or have the necessary rights to the images you upload
• Your images do not violate the privacy rights, publicity rights, copyright, or other intellectual property rights of any person
• Your images do not contain any explicit, offensive, or illegal content

4.3 We reserve the right to refuse or remove any user content at our sole discretion.

5. INTELLECTUAL PROPERTY

5.1 The Checkfit service, including its software, features, and functionality, is owned by Checkfit and is protected by copyright, trademark, and other intellectual property laws.

5.2 Your personalized AI model is created specifically for your use on our platform. While you maintain rights to your original uploaded images, the AI model generated from those images is provided as part of our service.

5.3 The images generated through our virtual try-on feature may be used for your personal, non-commercial purposes only.

6. PAYMENT TERMS

6.1 By providing payment information, you represent that you are authorized to use the payment method.

6.2 Subscription fees are billed in advance on a recurring basis according to the plan you select.

6.3 You can cancel your subscription at any time. Upon cancellation, your access will continue until the end of your current billing period.

6.4 No refunds will be provided for partial subscription periods.

7. LIMITATIONS OF LIABILITY

7.1 Checkfit provides its service on an "as is" and "as available" basis, without warranties of any kind.

7.2 We do not guarantee that:

• The service will be uninterrupted or error-free
• Generated images will perfectly represent how clothing will look on you in reality
• AI models will be 100% accurate or free from imperfections

7.3 In no event shall Checkfit be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service.

7.4 Our total liability for any claims under these Terms shall not exceed the amount you paid to Checkfit during the 3 months prior to the claim.

8. INDEMNIFICATION

You agree to indemnify and hold harmless Checkfit and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the service or violation of these Terms.

9. TERMINATION

9.1 You may terminate these Terms at any time by canceling your account.

9.2 We may terminate or suspend your access immediately, without notice, if we believe you have violated these Terms.

9.3 Upon termination:

• Your access to the service will cease
• Your AI model will be deleted within 30 days
• Sections on intellectual property, limitations of liability, and indemnification will survive

10. CHANGES TO TERMS

We may modify these Terms at any time by posting the revised version on our website. Your continued use of the service after changes constitutes your acceptance of the modified Terms.

11. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

12. DISPUTE RESOLUTION

Any dispute arising from these Terms shall be resolved through good faith negotiations. If such negotiations fail, the dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.

13. SEVERABILITY

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

14. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Checkfit regarding the service and supersede all prior agreements.
